Several states and MLS boards have also moved toward requiring disclosure when listing images are digitally altered, so agents should check both their MLS policy and their own state's advertising rules, which vary. A useful distinction is between adding removable items and changing the property. Adding a sofa to an empty room is generally acceptable with disclosure. Changing flooring, wall color, fixtures, removing cracks, hiding power lines or altering views misrepresents the home itself and can expose agents to misrepresentation claims even if labeled. A common misconception is that a 'virtually staged' label makes any edit acceptable. It does not; disclosure covers furniture, not fake condition.

The Future of AI Virtual Staging

Virtual staging is already common for vacant listings, and quality is likely to keep improving, including staging for video walkthroughs and 3D tours. As realism improves, the risk of misleading images grows, so disclosure rules are likely to become clearer and more widespread through MLS policies and possibly more state laws. Portals may add standard labels or ways to toggle between original and staged images. Buyers will probably become more accustomed to staged photos, which makes honest labeling and visible originals more important rather than less.
