India IT Rules on Deepfakes and Synthetic Content Labels

MeitY advisories remind intermediaries of due-diligence duties under India’s IT Act and IT Rules, while the 2026 amendments create binding requirements for synthetically generated information (SGI).
Current rules distinguish covered realistic audio-visual SGI, lawful-use exclusions, platform duties, and additional duties for significant social-media intermediaries.
India’s Ministry of Electronics and Information Technology has issued advisories reminding intermediaries that existing IT Act and Intermediary Rules obligations apply to unlawful content, including deepfakes. The 2023 and 2024 advisories emphasized user notices and platform action; later advisories in December 2025 and March 2026 addressed unlawful or misleading content and SGI. An advisory explains the Ministry’s expectations and points to existing duties, but the source of binding requirements remains the Act and notified Rules. The IT Rules were amended on 10 February 2026, with the SGI amendments taking effect on 20 February 2026. The definition focuses on audio, visual, or audiovisual information artificially created or altered to appear real and be perceived as indistinguishable from a person or real-world event. The Rules exclude specified good-faith editing, document preparation, and accessibility or translation work where the substance is not materially manipulated. The amendments add due diligence for intermediaries to prevent unlawful SGI and require labelling or metadata for permissible SGI. Significant social-media intermediaries face additional user declaration and technical verification duties before publishing SGI. The rules do not mean every AI-generated text or classroom illustration is SGI. They focus on defined audiovisual information and contain express exclusions. They also distinguish prohibited unlawful content from permissible synthetic content that must be labelled. Different removal and grievance timelines can apply depending on the content and trigger, including complaint, actual knowledge, or a court/government direction. Do not describe an advisory as a general pre-approval requirement for AI products. Platforms should review the official Gazette text, identify which services enable creation or dissemination of SGI, implement applicable labels and provenance measures, communicate user duties, and route reports and takedown requests using the correct deadline. Recheck current MeitY FAQs and amendments before relying on older advisory summaries.

MeitY’s SGI amendments took effect in February 2026, and the Ministry continues issuing notices and FAQs. Further IT Rules changes may follow consultation and new Gazette notifications. Platforms should monitor official materials and avoid treating draft proposals or advisory language as enacted law. Review workflows when content features, user tools, or intermediary classification changes. MeitY can revise FAQs and issue further advisories, and later amendments may alter intermediary duties. Track Gazette notifications and commencement dates, distinguish final rules from consultation drafts, and update internal procedures after a legal change.
