Maryland’s law is a useful example of a narrowly scoped safeguard: the trigger is a particular actor, context, technology function and purpose, with a specified consent mechanism.

The provision remains codified in Maryland law. Employers should check the current statutory text and product behavior when adopting interview tools, because vendor features can change even when the statute does not. Other state and federal rules may add obligations beyond this Maryland-specific consent requirement. Maintain a dated record of the official source checked, the relevant section and any operational interpretation. When facts change, update policies and training materials together so staff do not rely on a stale summary or treat a proposed measure as an effective legal requirement.
