Marketing is the lowest-risk use: drafting website copy, directory bios and newsletters that contain no client data. The legal frame is HIPAA. Any vendor that creates, receives or stores protected health information on a practice's behalf is a business associate and must sign a business associate agreement (BAA). Consumer chatbot accounts generally do not come with one, so pasting session details into them is a privacy violation waiting to happen. For self-pay and uninsured clients, US practices must also provide a Good Faith Estimate of expected charges under the No Surprises Act, which software can generate but the clinician must check. Two misconceptions cause most trouble. The first is that deleting a client's name makes text anonymous. HIPAA's Safe Harbor method lists 18 identifier types, including dates and geographic details, and a rare life event can identify someone on its own. The second is that AI billing or notes shift responsibility. The clinician who signs a note or submits a claim is accountable for its accuracy, so a fabricated symptom or an upcoded service in an AI draft is the clinician's problem, not the vendor's. Recording sessions also requires informed client consent, and some states add stricter rules.
