Predictive seller models score properties on signals linked to moving. These include how long the owner has lived there, estimated equity, the owner's life stage, mortgage details, permit activity, and public records such as probate, divorce or pre-foreclosure filings. Vendors such as SmartZip, Offrs and Likely.AI sell these scores to agents. The catch is the base rate. In a typical year only a small share of homes sell, so even a good model's top list is mostly people who will not move soon. Its value is focusing marketing spend, not finding sure things. On the follow-up side, speed and persistence matter. AI assistants in CRMs and add-on tools answer inquiries within minutes at any hour, ask qualifying questions, book appointments and keep dormant leads warm, then hand off to a human when someone is ready. The TCPA, passed in 1991, is the main limit. It restricts calls made with an autodialer or an artificial or prerecorded voice to cell phones without prior express consent, and telemarketing calls of that kind require prior express written consent. Text messages are treated as calls. In Facebook v. Duguid (2021), the Supreme Court narrowed the autodialer definition to equipment that uses a random or sequential number generator, but that ruling did not touch the artificial-voice rules. In early 2024, the FCC ruled that AI-generated voices count as artificial under the TCPA. Telemarketing rules also cover the National Do Not Call Registry and limit calls to between 8 a.m. and 9 p.m. in the recipient's local time. Damages are $500 per violation, up to $1,500 if willful or knowing, which adds up fast across thousands of texts. Some states, such as Florida, have their own stricter laws. A common misconception is that a phone number found in public records or a purchased list can be texted freely. It cannot.

The Future of AI Real Estate Lead Generation

AI follow-up is likely to become standard in real estate CRMs, with more conversational voice and text agents. Because the FCC treats AI voices as artificial, voice automation will stay tied to documented consent. Consent rules are still in flux, with court challenges and further rulemaking still shaping requirements, and state laws may add further restrictions. Predictive seller scores will probably improve slowly as data sources grow, but the low base rate means they will remain tools for prioritizing outreach rather than forecasts of who will sell.

A brokerage drops a plan to have an AI voice agent cold-call expired listings after a compliance review notes that artificial-voice calls need prior consent and that numbers must be checked against Do Not Call lists.
