Those personal examples triggered a New York State Department of Financial Services investigation. Goldman Sachs Bank USA issued the card and made underwriting decisions; Apple marketed and designed parts of the consumer experience. The regulator reviewed underwriting policies, data and consumer complaints rather than treating a viral comparison as conclusive evidence. In March 2021, DFS analyzed underwriting data for about 400,000 New York applicants plus documents and interviews. It found no evidence of intentional or disparate-impact discrimination under the fair-lending rules reviewed. This finding is limited to that product, data and investigation; it is not proof that every credit model is unbiased. DFS also criticized customer-service and transparency deficiencies: applicants did not always receive clear explanations of terms. Spouses’ shared finances do not make their individual credit files, debts or underwriting profiles identical. The report discussed authorized users, credit-building and fair-lending obligations for algorithmic methods. The case is often misreported as a regulator proving the algorithm sexist or proving algorithms cannot discriminate. Neither is accurate. The regulator did not find unlawful discrimination in its reviewed evidence, but it stressed explanation and fairness duties. A separate CFPB enforcement action in 2024 addressed Apple Card transaction-dispute servicing and related consumer-protection issues, not gender underwriting. Status has since changed: as of September 26, 2026, CFPB records show Apple’s consent order was terminated on September 22, 2025 after Apple paid its $25 million penalty; the CFPB’s Goldman Sachs page and docket still list the October 2024 consent order requiring consumer redress and a civil penalty. Neither enforcement record changes what DFS found in its 2021 underwriting investigation.

The DFS finding remains a dated outcome of its 2019–2021 investigation. The CFPB’s later servicing action was separate from gender underwriting; its Apple order was terminated in 2025, while the agency still lists the Goldman order. Recheck official dockets before describing current enforcement status. When discussing the case, verify the exact regulator, decision date, product role and issue under review. Explain that the report’s conclusion concerns the evidence and law in that inquiry; a different model, time period or credit product needs its own review. This distinction avoids turning a regulator’s narrow result into a universal statement about automated lending.
