Generative systems can alter faces, voices, scenes, or entire recordings. The resulting file may look and sound plausible, but plausibility is not proof of authenticity. Courts have long handled disputes about whether an exhibit is what its proponent claims. Under Federal Rule of Evidence 901(a), the proponent must produce evidence sufficient to support a finding that the item is what the proponent claims it is. Rule 901(b) gives examples of authentication methods, including witness knowledge, distinctive characteristics, and evidence about a process or system. State rules may differ, and authentication is only one part of admissibility. A party raising a deepfake concern should identify a grounded reason for the challenge. Signs may include inconsistent lighting, unnatural motion, unexplained edits, provenance gaps, or a mismatch with other reliable evidence. These are leads, not conclusive tests: compression artifacts and ordinary camera effects can also look unusual, while sophisticated manipulation may leave few visible clues. Metadata can help establish history but can be altered or stripped. A forensic examiner may compare files, inspect encoding, or assess audio-visual consistency, yet no single detector or score settles every case. Preservation matters. Keep the earliest available file, document how it was obtained, retain hashes and transfer records, and avoid editing the only copy. Record the device, platform, download method, and any conversion steps. If the file has passed through messaging apps or editing software, that context may explain missing metadata or compression. The parties should distinguish the question “is this the same file that was collected?” from “does this file accurately depict the event?” A cryptographic hash can help answer the first question after collection but cannot prove that the original recording was genuine. A court decides authentication and admissibility under the governing rules, considering the evidence and objections presented. A party’s unsupported assertion that media is synthetic should not automatically exclude it; likewise, a polished recording should not be accepted solely because it looks real.

The Future of Deepfake Evidence and Authentication in Court

Synthetic media will become easier to create and harder to judge by appearance alone. Courts, agencies, and standards groups may refine guidance on preservation, disclosure, and technical testimony, but legal procedures will vary. Provenance features and signed capture systems could provide useful evidence about a file’s path; they cannot guarantee that the scene itself was truthful or that every later edit is detectable. As tools change, parties will need to preserve original files, disclose transformations, test experts’ assumptions, and combine technical findings with witnesses and other evidence. The durable safeguard is a transparent evidentiary record evaluated under the applicable rules.
