Credit-underwriting models estimate credit risk or support lending decisions.

Their use is subject to applicable lending, fair-lending, and notice requirements; model scores are not legal determinations.
Credit-underwriting models estimate risk or support lending decisions and remain subject to applicable fair-lending and notice requirements. Current Regulation B at 12 CFR 1002.9 governs adverse-action notices. A notice may provide the specific reasons or explain the applicant’s right to request them; when a creditor supplies a statement, it must give specific principal reasons that accurately describe factors actually used. CFPB circulars issued in 2022 and 2023 that discussed complex algorithms were withdrawn on May 12, 2025; they are historical guidance, not current authority. Features associated with protected characteristics can raise proxy-discrimination risks, but correlation alone does not establish unlawful disparate impact. Legal analysis depends on applicable rules, evidence, and facts. Thin-file applicants have little traditional credit history; relevant alternative or cash-flow data may help assess some applicants, subject to validation, coverage, and fair-lending controls. SHAP assigns feature-importance values to an individual prediction under specified assumptions; it is not causal proof or a legal explanation by itself.
Validate a model against the lending task and population.
Review proxy variables and outcome differences across groups.
Generate adverse-action reasons that correspond to factors actually used.
Provide applicant recourse and human review where required.
Underwriting rules and guidance can change. Lenders should review current legal requirements and model governance before deployment; this guide is educational, not individualized financial advice.

A feature can act as a proxy when it is associated with a protected characteristic or group. That association may raise fair-lending risk, but whether a practice violates law depends on the facts, evidence, and applicable legal standards; correlation alone is not an automatic legal conclusion.
An adverse-action notice informs the applicant that the creditor took an adverse action on the application.

SHAP assigns feature-importance values to a particular prediction under its model and background assumptions. Those attributions describe model behavior; they do not by themselves establish that a feature caused the outcome or that the decision is legally fair.
