Keep input and output questions separate. Permission to access a work is not necessarily permission to reproduce, adapt, distribute, or use it for every training purpose. The source license, contractual terms, intended use, and applicable law need their own review. For U.S. copyrightability, the Copyright Office’s 2025 report emphasizes human authorship. AI assistance does not automatically disqualify a work, but merely providing prompts does not by itself establish the human control over expressive elements needed for protection. The specific human contribution matters. An output’s copyrightability is different from whether using it could infringe someone else’s rights. Review recognizable protected material, attribution obligations, and third-party assets. A service’s output terms describe its relationship with the user; they do not necessarily grant rights owned by another party. Keep records of source materials, licenses, edits, and the human creative work when publishing. For a consequential commercial or disputed use, obtain advice appropriate to the jurisdiction and facts. Treat legal conclusions as specific to the issue and date rather than making blanket claims that all AI output is free to use.

Technisch inzicht

A model license, a dataset license, a service agreement, and rights in a particular output are different layers. Compliance with one does not automatically satisfy the others.

Separate rights questions

  1. Imagine a designer using an authorized tool to draft an illustration and then making substantial original edits.
  2. Record the tool terms and source assets, the designer’s expressive contributions, and any third-party material recognizable in the result.
  3. Assess copyrightability and potential infringement as separate questions instead of assuming that permission from the tool provider answers both.

The hypothetical example organizes the analysis; it does not determine the legal status of a particular work.
