Public Records Requests for Government Algorithms

Requests may reveal contracts, manuals, validation studies, input lists, or audit records, but access depends on possession, scope, exemptions, and redactions. A request does not guarantee access to source code or a complete model.

A public-records request is a formal way to ask a government body for records it holds. In the United States, federal FOIA covers records of federal agencies; state and local agencies are generally governed by their own open-records laws. The UK Freedom of Information Act 2000 applies to recorded information held by public authorities, subject to exemptions. These laws do not force an agency to create a new analysis or answer a broad question. Ask for records that exist, such as contracts, procurement files, policy manuals, model cards, validation studies, audit summaries, training materials, and use logs. Algorithm-related records may be withheld or redacted under exemptions for personal privacy, law-enforcement techniques, trade secrets or commercial information, cybersecurity, or other protected interests, depending on the statute and facts. An agency may not possess the vendor’s source code, or it may rely on contractual restrictions. That does not mean there are no useful records: scope documents, impact assessments, error analyses, oversight procedures, and invoices can help reconstruct how a system is used. A request does not guarantee disclosure of the model itself. A clear request identifies the agency, system or vendor if known, record types, date range, and preferred format. Ask for electronic versions and partial release of non-exempt portions. Separate requests for contracts, performance studies, and use policies can be easier to process than a single demand for “everything about the algorithm.” Keep correspondence, track deadlines, and use administrative appeals or court review if the law allows. Public records can support independent accountability but are not a complete audit. Records may be incomplete, withheld, or out of date, and a data file alone may not show the model’s effects. Pair documents with interviews, technical analysis, and affected-community perspectives. Explain what the documents establish and what remains unknown.

Prior disclosures can help refine a request, but a granted request does not replace independent technical review.
